企业法人名称的批准

The procedure of getting the name agreed for commercial and non-commercial organizations, requirements to the names of organizations are defined by Resolution of the Council of Ministers of the Republic of Belarus No 154 of February 5, 2009 “On Approval of Regulations on Agreement Order of Names of Commercial and Non-commercial Organizations” and Resolution of the Ministry of Justice of the Republic of Belarus No 20 of March 5, 2009 “On Agreement of Names for Legal Entities”.

The names that have been registered or reserved in the database of the Unified State Register of Legal Entities and Individual Entrepreneurs shall not be registered. Please follow the link and write down the name of the organization you are planning to use to check if it is included in the list of the Unified State Register.

Controversial issues of agreement of the name of a legal entity are resolved by the Ministry of Justice of the Republic of Belarus if the registering body shall not agree the name of the organization.

To get the name of a legal entity agreed you may either:

• personally appeal or post the documents to the registering body
• or go online on the website of the Unified State Register (egr.gov.by)

To get the name agreed by personal appeal or posting the documents to the registering body the application form shall be fulfilled.

If requested, the following documents shall be submitted:

• permission for using surnames, pseudonyms of famous persons or names used in cases established by law;
• a copy of the document duly certifying authority of the applicant in case the documents are submitted by legal or individual’s representative. The following persons may apply to the registering body for the agreement of the name of a legal entity:
• if the legal entity is established by the property owner (founder, participant), a natural person or his representative authorized by the power of attorney may apply for the agreement of the name of a legal entity;
• if the legal entity is established by a legal entity as a founder, the head of the legal entity or a person authorized to act on behalf of the organization by constituent documents, or the representative of the founder that acts by power of attorney may apply for the agreement of the name of a legal entity;
• if the legal entity is functioning, the head of the legal entity or a person authorized to act on behalf of the organization by constituent documents, or his representative authorized by the power of attorney may apply for the agreement of the name of a legal entity (section 2 of Resolution of the Council of Ministers of the Republic of Belarus No 154 of February 5, 2009 “On Approval of Regulations on Agreement Order of Names of Commercial and Non-commercial Organizations”).

Certificate on agreement (disagreement) of the chosen name shall be issued on the day of your application. The certificate is valid for 1 month starting from the day the name was agreed.
